Sham Grievance Investigation & Outcome:
A poorly written grievance letter provides your employer every opportunity to rubbish what you have stated, and moreover, to conduct a sham grievance investigation.
A sham grievance investigation perverts the natural justice and divests an aggrieved employee of receiving effective remedy and redress to their grievances. See W A Goold (Pearmak) Ltd v McConnell [1995] IRLR 516:
“Further, it seems to us that the right to obtain redress against a grievance is fundamental for very obvious reasons.”
Employers are notorious for conducting a sham grievance investigation where the employee has failed to establish the employer’s liability. This is why it is so very important that you do not give your employer the opportunity to rubbish your grievance letter.
An employer who conducts a sham grievance investigation and who fails to address the aggrieved employees’ grievances is a breach of the implied term of mutual trust and confidence, as held in the authority of Dr S Stothard v Durham University 2500306/2019 at paragraph 41:
“In relation to the grievances, it was found in W A Goold (Pearmak) Ltd that there is “an implied term in the contract of employment that the Employers would reasonably and promptly afford a reasonable opportunity to their employees to obtain redress of any grievance they may have”. In this case, the respondent failed to provide that opportunity to the claimant and there was, therefore, a breach of that implied term.”

A well-written grievance letter will make it very difficult for an employer to conduct a sham grievance, and where it does, an inference can subsequently be drawn against the employer in an Employment Tribunal.
