The paragraphs below outline a witness statement / statement of truth to assist you in writing a witness statement or statement of truth.
How to start a witness statement:
- Firstly, put the date at the top of the witness statement/statement of truth.
- Secondly, put your full name and address at the top of the witness statement / statement of truth.
- Thirdly, I would suggest you make the following statement underneath your name and address:
“This witness statement is a statement of truth, which facts and information I am prepared to swear under oath and/or affirmation as being substantially true to the best of my knowledge and recollection.”
- Fourthly, your witness statement or statement of truth needs to outline both ‘facts’ and ‘information’. You must keep your witness statement / statement of truth to the truth i.e., what you heard or observed.
- Fifthly, less is more. The less you write in your witness statement or statement of truth, the better. For example, in an Employment Tribunal, you can only be crossed examined on what you have stated within your witness statement or statement of truth. The more you write in your witness statement or statement of truth, the more you allow your employer’s solicitors to find a chink in your armour.
- Sixthly, if you are writing a witness statement for the Employment Tribunal, the witness statement or statement of truth should follow the paragraphs in your ET1 or Tribunal claim.
- Seventhly, if you are the complainant, and your witness statement is in support of your grievance letter or court claim, your witness statement or statement of truth should outline your feelings, what you felt, and what you perceived.
Witness Statement Example 1 Sexual Harassment:
On 6.5.26, I was standing at the photocopy machine at 4:15 pm, when Phillip Thomas brushed past me and pushed his groin into my buttocks. I considered this course of conduct sexual assault. Phillip Thomas brushing his groin against me was unwanted, uninvited, and unwelcome to me. I felt violated. This course of conduct created an oppressive environment in which to work and communicate with Phillip Thomas. At first, I did not report the incident of sexual harassment. However, having discussed what happened to me with my workplace colleague Tanya Smith later the same afternoon, Tanya Smith informed me that Phillip Thomas had done the same to her the previous week. Therefore, it is clear that Phillip Thomas has a habitual proclivity to sexually harass and sexually assault female employees. Such sexual proclivities have no place in the working environment. This incident left me feeling violated.
Witness Statement Example 2 Disability Discrimination:
On 6.5.26, I informed my line manager James Brown that I had a medical appointment with my GP on 8.6.26. I asked James Brown to allow me time off from work to attend the medical appointment by reason that I could not get an appointment with my GP on my day off. For the avoidance of doubt, James Brown knows I suffer from anxiety and depression as I have previously taken time off from work to attend counselling sessions. Notwithstanding, I have sent Fit Notes to James Brown, which Fit Notes cited ‘anxiety and depression’ as the cause of my disability-related sickness absence from work. James Brown refused to allow me to take the time off from work to attend the medical appointment with my GP. James Brown omitted to make a reasonable adjustment for my disability. James Brown discriminated against me on protected grounds of disability by refusing to allow me time off from work to attend the medical appointment, which is a contravention of The Equality Act 2010. James Brown omitted to outline any legitimate reason why I could not take time off from work to attend my GP appointment. As such, I feel discriminated against because of my disability. It was incumbent upon my employer to have rendered James Brown with disability-awareness training. The omission to have rendered James Brown with disability awareness training has ultimately led to James Brown discriminating against me because of my disability. This is how I feel.
Witness Statement Example 3 Religious Discrimination:
On 6.5.26, I was loading baggage onto flight number 741 (Gatwick to Rome) with my co-worker Mohammed Assan, when our supervisor Mark Phillips approached us and joked that he hoped we hadn’t put any bombs in the luggage. As Muslims, we found this ‘joke’ highly offensive. Mark Phillips inferred that because we are Muslims that we are terrorists. Mark Phillips knew (or reasonably ought to have known) that his ‘joke’ was calculated with the purpose and effect to cause myself and Mohammed Assan injury to our feelings, which being labeled as terrorists did do. This ‘joke’ was unwanted, unwelcome, and univited to us. Being harassed because of our religion is a contravention of The Equality Act 2010. The fact that Mark Phillips believed it was reasonable to make such an offensive remark related to our religion, evidences the fact that our employer has not done nearly enough to eradicate and eliminate harassment and discrimination within the workplace.
